These standard provisions apply to all agreements with Køkkensnedkerenunless otherwise agreed in writing.
Quotations and order confirmation
Offers are binding and the price is fixed for 14 days from the date of the quotation. Specified prices are excluding VAT and freight/delivery and setup/assembly costs are shown in quotations.
The buyer’s acceptance of the quotation is binding and to be considered as an order confirmation. The order confirmation is at the same time confirmation that the order can be put into production, after which there can be no changes to the order without written agreement.
The buyer is encouraged to ensure that quotation and order confirmation are in accordance with their wishes, including the time and place of delivery. Invoices are issued to the recipient of the quotation.
Delivery
The delivery agreed in the order confirmation is delivered to the buyer’s address as specified in the quotation. If the address is occupied, a person must be present on delivery.
A large moving truck must have access to a location 10-20 m from the entrance door, and delivery of the products by trolley must be possible without the use of other means, such as a lift. Otherwise a reloading fee is imposed, any cost of additional aids is charged to the buyer.
The buyer must provide a space for the delivery, which is cleared and dry. All access routes must be freely accessible. Before delivery, the buyer ensures the necessary covering of floors, stairs and other access roads at the residence. If there are special conditions regarding the delivery, this must be agreed with Køkkensnedkeren in advance, so that delivery can be made without the risk of damage to elements, worktops, appliances, fixtures or the residence. If delivery cannot take place under the above conditions, or if the delivery and assembly is postponed by the buyer, the buyer shall be charged all additional costs in connection with the delivery e.g. for storage, additional transport, etc.
The risk of the delivery, including insurance liability, passes to the buyer when the delivery has been made at the agreed delivery address. For any delivery to alternative addresses, the order is considered delivered. In case of postponement, setup/assembly cannot be expected to be performed immediately after delivery. Any postponement of delivery/assembly does not justify postponing payment for the order. Delayed delivery/assembly or misdelivery does not entitle the buyer to cancel the order in whole nor in part. In connection with delivery and assembly, reservations are made for lockouts, strikes, supplier delay and other force majeure events. No claim for damages of any kind may be claimed by the buyer in such cases.
Payment and retention of property
The agreed payment terms are set out in the quotation/order confirmation. If partial delivery has been agreed, each delivery is due for payment at each partial delivery.
There can be no withholding or offsetting in the purchase price on the grounds of counterclaims not approved in writing by the supplier or Køkkensnedkeren. In case of late payment, the amount due is remunerated in accordance with the provisions of the Danish Interest Act. Køkkensnedkeren calculates the fee when sending a payment reminder to the buyer in case of non-payment.
Køkkensnedkeren is entitled to withhold supplies if the amounts due have not been paid and reserves the right to obtain a security for the purchase price before delivery in the form of a bank guarantee, transport or other security approved by Køkkensnedkeren. Køkkensnedkeren has the ownership (retention of title) of the items sold, including those delivered, until full and final payment, including any accrued interest, has taken place.
Warranty and complaints
Køkkensnedkeren has the right of remediation, setup and delivery. The remedy of defects is done in accordance with the Rules of the Danish Sale of Goods Act.
Køkkensnedkeren provides a 3-year warranty on moving metal parts, such as hinges, drawer rails, fittings, wire goods, pull-outs and carousels. The warranty does not cover waste systems, mixer taps, etc. A 2-year warranty is given on electric drawers and micro hinge fittings with gas cartridges.
Conditions caused by improper assembly or abnormal use and wear are not covered by the warranty. The warranty only covers when presenting a dated warranty certificate and is valid for as long as the product is in use and functional at the address shown in the guarantee certificate.
Wood and other natural materials are unique and colour shades and structures may thus vary. Humidity, frost, light and heat affect the natural materials. Solid wooden countertops must be stored in a dry place, horisontally and supported.
Any complaints arising from a lack of vigilance in relation to these matters are not accepted.
Immediately upon receipt, the buyer is obliged to examine the products and the completion of the setup/assembly. If there is a defect in the order, the buyer has a right of complaint under the Danish Sale of Goods Act.
The buyer is obliged to make Køkkensnedkeren aware of any defects. In case of visible defects, the buyer must notify Køkkensnedkeren within 8 days of receipt and before the product is installed/set up. Failing to notify accordingly, the buyer has forfeited the right to invoke the defect.
Return provisions
It is not possible to return items and countertops as these are specially manufactured to the buyer’s request. By prior agreement, it is possible to return stocked standard items such as external handles, halogen spots and mixer taps, provided that the goods are undamaged and in their original packaging. Returned items are credited with 50%.
Assembly work (setup)
If setup/assembly has been agreed, it is a prerequisite that the room at the residence is prepared for the setup, i.e. floors, walls and ceilings are prepared and suitable for setup. There must have been no change in the dimensions of the room as recorded by Køkkensnedkeren when surveying prior to quotation.
All fixed installations, including drains, water, vents and electricity, must be ready for use and connection before the setup and must be legal.
Setup/assembly in the room does not include finishing such as painting, tiles, instalment of lights and fixtures and the like. The connection of appliances, water and drains must be carried out by our own authorised electrician/plumber.
If non-preparation of the room/building results in additional work or extra transportation, Køkkensnedkeren reserves the right to charge reasonable additional costs.
Construction work, including electricity, painting and plumbing agreed directly with the contractor or craftsman, is irrelevant to Køkkensnedkeren.
Security and guarantee
Køkkensnedkeren is a member of the two boards of appeals Køkken Anke Foreningen KAF and Køkken Garantiforeningen. Disputes regarding deliveries may be brought before KAF, Kejsergade 2, 1155 Copenhagen K. (www.koekkenanke.dk)
Køkkensnedkeren is not responsible for lost earnings, operating losses or other indirect losses in connection with delivery, setup or any complaints.
Jurisdiction and product liability
Køkkensnedkeren’s domicile shall be the venue for any dispute arising from this Agreement.
Køkkensnedkeren disclaims any product liability that does not result from the mandatory rules of the Product Liability Act, including loss of operations or any other loss.
